Terms and Conditions

1. Acceptance of Terms

By accessing or using dapr ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

dapr is operated by Pawty Wagon, LLC ("we," "us," or "our"). The App is designed to help users connect with others at in-person events.

2. Eligibility

You must be at least 18 years old to use dapr. By using the App, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into these Terms
You will comply with all applicable laws and regulations

3. Account Registration

3.1 Account Creation

You must create an account to use dapr
You must provide accurate, current, and complete information
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account

3.2 Account Security

You must notify us immediately of any unauthorized access to your account
We reserve the right to suspend or terminate accounts that violate these Terms
You may not transfer or share your account with others

4. User Conduct

4.1 Prohibited Conduct

You agree NOT to:

Harass, abuse, threaten, or intimidate other users
Post or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity
Use the App for any commercial purpose without our written consent
Share sensitive personal information (passwords, financial data, health records) with dappy or other users
Create fake events or spam events
Use automated systems (bots, scrapers) to access the App
Attempt to gain unauthorized access to the App or other users' accounts
Violate any applicable laws or regulations

4.2 Event Attendance

You agree to show up to events you register for
Repeated failure to attend registered events ("flaking") may result in points penalties or account suspension
You must check in at events using the provided method (QR code or geofence)
You may not falsify attendance or check-in on behalf of others

4.3 Squad Conduct

Squad creators are responsible for ensuring all members consent to being part of the squad
Squad members may leave squads at any time before event check-in
Squads must not be used for harassment, exclusion, or discriminatory purposes

5. DAP System

5.1 DAP Functionality

"DAP" is a feature that allows users to express interest in meeting other users at events
DAPs can be sent to individuals or squads
Mutual DAPs create a time-limited chat (10 minutes)
You may DAP multiple users per event

5.2 DAP Conduct

DAPs must be used in good faith to facilitate in-person meetings
You may not use DAPs for harassment or unwanted contact
Users may report inappropriate DAP behavior

6. Chat and Communication

6.1 Chat Features

Matched users can communicate through in-app chat
Chats are facilitated by "dappy," an AI assistant
Chats automatically expire after 10 minutes or upon proximity verification
Chat messages are permanently deleted after expiration

6.2 Chat Conduct

You are responsible for all messages you send
Do NOT share sensitive information (passwords, financial data, health information) in chat
Inappropriate messages may result in account suspension or termination
We reserve the right to monitor chats for safety and compliance purposes

6.3 dappy AI Assistant

dappy is an AI-powered assistant designed to facilitate connections
dappy learns your preferences through chat interactions and event attendance
dappy provides compatibility suggestions based on user behavior patterns
You acknowledge that dappy's suggestions are not guaranteed to be accurate
dappy does not store individual chat messages beyond the chat session

7. Content and Intellectual Property

7.1 User Content

You retain ownership of content you post (photos, bio, messages)
By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with operating the App
You represent that you have all necessary rights to post your content

7.2 Our Intellectual Property

The App, including all software, designs, text, graphics, and other content, is owned by us or our licensors
You may not copy, modify, distribute, or create derivative works without our written permission
"dapr," "dappy," and associated logos are our trademarks

8. Privacy and Data Collection

8.1 Data We Collect

Profile information (name, age, photo, bio, interests)
Event attendance and check-in data
Chat messages (temporarily, during active sessions only)
Location data (when checking into events)
Device and usage information

8.2 How We Use Data

To provide and improve the App's functionality
To facilitate connections between users
To generate aggregate event "vibe" scores
To enforce these Terms and ensure user safety

8.3 dappy Data Usage

dappy analyzes your chat patterns and event attendance to provide personalized suggestions
Individual user data is NOT shared with other users
Only aggregate "vibe" information is displayed at events
You may opt out of personalized suggestions in Settings

9. Points System

9.1 How Points Work

Users earn points by attending events (checking in and staying)
Users lose points by registering for events and not attending ("flaking")
Points may be required to create spontaneous (unorganized) events
Points do not have monetary value and cannot be transferred

9.2 Points Adjustments

We reserve the right to adjust points balances for violations of these Terms
Points balances may be reset or modified at our discretion

10. Events

10.1 Organized Events

Organized events are official dapr-hosted or partnered events
These events use QR code check-in for attendance verification
Organized events guarantee a minimum quality standard

10.2 Spontaneous (Unorganized) Events

Users with sufficient points may create spontaneous events
Spontaneous events are user-generated and not verified by dapr
We are not responsible for the quality, safety, or accuracy of spontaneous events
Users attend spontaneous events at their own risk

10.3 Event Cancellations

Events may be cancelled by organizers or by the App
If an event doesn't meet minimum attendance requirements, it may be auto-cancelled
We will notify registered users of cancellations when possible

11. Safety and Reporting

11.1 User Safety

Always meet in public places
Inform friends or family of your plans
Trust your instincts - if something feels wrong, leave
We are not responsible for in-person interactions between users

11.2 Reporting

You may report users who violate these Terms or engage in inappropriate behavior
Reports are reviewed and may result in warnings, suspensions, or permanent bans
We reserve the right to cooperate with law enforcement

12. Disclaimers and Limitations of Liability

12.1 No Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The App will be uninterrupted or error-free
The App will meet your specific requirements
dappy's suggestions will be accurate
Users you meet will be compatible or safe

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, or consequential damages
Any damages arising from your use of the App or interactions with other users
Any damages resulting from unauthorized access to your account
Any damages from events attended through the App

12.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

Your violation of these Terms
Your use of the App
Your interactions with other users
Content you post

13. Termination

13.1 Termination by You

You may delete your account at any time through the App settings
Deleting your account does not delete past event attendance records or reports filed against you

13.2 Termination by Us

We may suspend or terminate your account at any time for:

Violation of these Terms
Fraudulent or illegal activity
Harassment or abuse of other users
Repeated flaking or bad behavior
Any reason we deem necessary to protect the community

13.3 Effect of Termination

Upon termination:

Your access to the App will be revoked
Your profile will be removed
Your points balance will be forfeited
We may retain certain data as required by law or for legitimate business purposes

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by:

Posting a notice in the App
Sending an email to your registered email address
Requiring acceptance of new Terms upon login

Continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of New York State, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Good faith negotiation first
Binding arbitration if negotiation fails (except where prohibited by law)
Arbitration shall be conducted by [ARBITRATION PROVIDER] under their rules

15.3 Class Action Waiver

You agree to resolve disputes individually and waive your right to participate in class action lawsuits.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and dapr.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms without our written consent. We may assign these Terms to any successor or affiliate.
